This is update to my original review of Century 21 Award and Ms. Holmes. Due to location of the property and massive issues with the house that were not identified by selected by Ms. Holmes house inspector, Orange County Assessor reduced valuation of the property from $720,000 (which was purchase price) to $598,000. House had more than $100,000 in damages, the roof damaged during fumigation had over 100 broken tiles about which Ms. Holmes was notified but decided not to inform me, the pest inspection report by selected by Ms. Holmes England Exterminating was not completed and listed only fraction of termite damages. Certificate of completion issued while house was still being fumigated was fraudulent and listed as completed numerous damages that were not repaired at all. Since Ms. Holmes prevented me from having real estate agent representing my interest and limited my access tot he house during escrow, I purchased house with numerous structural problems, kitchen had to be gutted to the studs, my home insurance was cancelled, broken during fumigation roof tiles had to be replaced, massive termite damage repairs were done over 1.5 years after escrow closed and only after I filed complaint with the Structural Pest Control Board of state of California. I used my life savings to purchased what I though would be my dream house in which I retire, instead I purchased a true nightmare with the over $100,000 repair bill attached. That was house advertised by Ms. Holmes as pristine and meticulously maintained.

In June 2014 Ms. Christy Holmes of C-21 Award at Rancho Santa Margarita as a dual agent sold me house in Mission Viejo. She had contract with the seller, but told me that she has to represent me as well. I was concerned about conflict of interest. Ms. Holmes sent me CMA's for the Mission Del Lago area around the lake, using newer and newly renovated properties with average price of $775,000 despite that comparable houses in Mission Viejo Central where subject property was located were selling for about $80,000 - $100,000 less. The property was flipped distressed property with 41 years old appliances, many of them not operational, staged for the purpose of its sale to the unsuspected buyer. The house had stains on kitchen kick boards and stains in the hall closets not disclosed in house inspection report. Seller was late with seller disclosures and termite report, I finally obtained termite report 12 days after acceptance. Seller disclosures indicated that there was leak in 2012. Termite report listed section 2 damages (stains in hall closets). Despite that buyer has right to access property, I was not allowed to enter property after I received termite report until due diligence period expired. My several inquiries about 2012 slab leak remained without any answer. Despite seller being late with their disclosures, and buyer having right to take 10 days to review documents, on 4/23/14 I received request to remove all contingencies. I told Ms. Holmes because sellers did not want to provide permits I will not be buying property. Then she send me email in which she told me that seller agreed to provide permits. In violation of January 2014 law which indicated that buyer had right to be present during appraisal, I was excluded from appraisal and appraiser used as comps newly renovated properties with new kitchens, new roofs, new hardwood floors, numerous amenities as comps. Some of those properties were significantly larger and newer. Ms. Holmes was arranging pest control for the sellers. She was telling me that fumigation is taking place after escrow closes and when I did not want to agree to that, twice arbitrarily she extended duration of the escrow. I was forced to pay entire down payment of $320,000 and escrow charges ahead of seller completing repairs and obtaining requested by me permits in violation of purchase agreement. To make long story short, despite my request I never received accounting of repairs performed by seller in violation of paragraph 14 of the purchase agreement, permits provided to me were after the fact permits, broken during fumigation roof tiles were never repaired, termite certificate of completion was issued while fumigation was still going on in violation of California Structural Pest Control regulations. After close of escrow I've learned that termite completion report was listing as completed section 1 repairs that were never done, and repairs that were done were violating pest control workmanship standards. The house had long term mold and water damage and not only kitchen cabinets but also dry walls had to be removed. After the fact permits had been issued despite of numerous violations of building code such as for example water supply line re-route to the kitchen, the 1998 backyard patio permit was issued to Tom Hunter despite of elimination of the drip skirt and incorrect grading of the backyard etc. Taking advantage that I did not have real estate agent representing my interests, Ms. Holmes sold me a house that was advertised as pristine and meticulously maintained, but in effect was a skillfully staged flipped distressed property. Dual Agency eliminated any checks and balances from the process, my complaints to Glen Oaks escrow, Century 21 Franchise Orange County Association of Realtors and mortgage lending companies were disregarded. Institution of dual agency should be made illegal in California so other buyers do not suffer they way I do.
